Welcome to visyoner. These Terms of Service ("Terms") govern your access to and use of the visyoner personal finance platform ("Service"). Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use visyoner. By using the Service, you represent and warrant that you meet these requirements.

2. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at [not configured] if you suspect any unauthorized use of your account.

3. Permitted Use

visyoner is provided for your personal, non-commercial financial management. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.
• Use automated means (bots, scrapers) to interact with the Service.
• Resell, sublicense, or distribute the Service to third parties.
• Use the Service to store or transmit malicious code.

4. Financial Data and Third-Party Services

visyoner connects to your financial institutions via Plaid, a third-party financial data aggregation service. By connecting an account, you agree to Plaid's Terms of Service and Privacy Policy.

Financial data is provided for informational purposes only. visyoner is not a licensed financial advisor. Nothing presented by the Service — including AI-generated insights — constitutes financial, tax, investment, or legal advice. Always consult a qualified professional for advice specific to your situation.

5. AI-Generated Insights

visyoner offers AI-generated spending insights powered by third-party language models. These insights are generated algorithmically and may contain errors or inaccuracies. They are provided as general observations only and should not be relied upon as financial advice. You use AI-generated content entirely at your own risk.

6. Household Accounts

The household feature allows multiple users to share financial data within a single household. By inviting or accepting an invitation to join a household, you consent to sharing your financial data with other members of that household. The household owner is responsible for managing membership and access. We are not responsible for any disputes between household members.

7. Subscription and Billing

Certain features require a paid subscription. Subscription plans, pricing, and billing cycles are described on the Subscription page within the app. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are issued at our discretion in accordance with applicable consumer protection laws.

8. Intellectual Property

The visyoner name, logo, software, design, and all content we create are owned by us and protected by applicable intellectual property laws. You retain ownership of all financial data you input into the Service. You grant us a limited license to use that data to provide and improve the Service as described in our Privacy Policy.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that financial data will be accurate or up to date.

11. Limitation of Liability

To the maximum extent permitted by applicable law, visyoner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless visyoner and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason at our discretion, with or without notice. You may delete your own account at any time from Profile → Delete Account; doing so cancels any active subscription, revokes every linked institution's Plaid access, and permanently erases your personal information from our systems. Upon termination by either party, your right to use the Service ceases immediately.

14. Changes to These Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. The courts located in Calgary, Alberta have non-exclusive jurisdiction over any dispute arising from or relating to these Terms.

If you are a consumer (as defined under the consumer-protection laws of the Canadian province in which you reside), nothing in these Terms is intended to deprive you of the mandatory protections of those laws or to limit your right to bring a claim in the courts of your own province. Where any clause of these Terms conflicts with such mandatory consumer-protection law, that law prevails over these Terms.
